2. Definitions

“Website”: means the website www.havea.group developed by LILAS 3.
“Publisher”: means LILAS 3.
“Host”: means OCEANET TECHNOLOGY with an address at 12, impasse Joséphine Baker – 44800 Saint-Herblain – France, who hosts the Website and the personal data collected from Users via the Website.
“Users”: refers to all natural persons of legal age who access Website content and features.

3. Acceptance of the general terms and conditions of use

3.1 Use of the Website and any contribution to its content are subject to full acceptance of and compliance with these General Terms and Conditions of Use (hereinafter the “GTCU”).
3.2 Consequently, the User acknowledges having read the GTCU in full and declares to accept them without reservation.

4. Validity and modification of the GTCU

4.1 If any provision of these GTCU is declared null and void with regard to a legislative or regulatory provision in force and/or a court decision having the force of res judicata, the other provisions shall remain valid and applicable.
4.2 The Publisher reserves the right to modify the GTCU, the Website and its content, at any time, without prior notice, in particular to comply with legislative and regulatory changes.

5. Browsing the Website

5.1 The Publisher makes the Website available 24 hours a day, 7 days a week, insofar as permitted by the technical means at its disposal.

As Publisher, LILAS 3 is responsible for the content it has published. However, the information given on the Website is provided for information purposes only, it is not contractual, and the Publisher shall not be held liable for any inaccuracy in the information published. It may be modified or updated without notice. The Publisher also reserves the right to make improvements and/or modifications to the Website at any time, without notice.
The Publisher shall not be held liable for:
– Damage of any kind, direct or indirect, resulting from use of the Website, in particular any operating, financial or commercial loss, loss of programmes and/or data, in particular in the User’s information system, due, in particular, to technical or IT malfunctions, or incompatibility of the Website with hardware or software, without this list being exhaustive.
– Damage of any kind, direct or indirect, resulting from the content and/or use of the Website or to which Users may have access via the Website.
– Omissions and/or errors that may be contained in the Website.
– Unlawful content or activities that may be present on the Website without the Publisher’s due knowledge within the meaning of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy.
Use of the Website implies that the User acts in good faith, in compliance with the GTCU, at the risk of being held liable. The User is responsible for the use it makes of the Website.
The Publisher shall not be held liable if, in the case of force majeure or events beyond its control or events of justified necessity, it is obliged to modify, suspend or delete the Website.
The Publisher shall not be held liable for any User dissatisfaction with Website content or functioning.
The Publisher shall not be liable for any malfunction of the Internet preventing proper functioning of the Website, in particular due to external malicious acts.
The Publisher shall not be held liable in the event that one or more Users are unable to log in to their User account as a result of any technical fault or any problem related in particular to network congestion.
The Publisher makes every effort to provide Users with information and/or tools that are available and verified, but shall not be held liable for errors (in particular display errors on the Website or the sending of erroneous e-mails), lack of availability of information and/or the presence of viruses on the Website or on the websites to which the Website redirects, any malfunction of the Internet preventing the proper functioning of the Website (in particular due to external malicious acts); interruptions or delays in data transmission, malfunction of terminals, the User’s telephone line or servers, failures by Internet service providers or telephone operators, malfunctions of computer equipment or software; the loss of any e-mail and, more generally, the loss of any data, the consequences of any virus, computer bug, anomaly or technical malfunction, any damage caused to a User’s terminal, any technical, hardware or software malfunction of any kind that prevents or restricts the possibility of using the Website or that damages a User’s system.

7. Applicable law and jurisdiction

These General Terms and Conditions of Use are governed by French law. In the event of a dispute, and in the absence of an amicable solution, the case shall be brought before the courts of Nantes.
